The contract of employment

It is very important to ensure that the contract is signed and returned by the employee, preferably before they start employment. At the latest the contract must be provided within two months of the employee commencing employment. The contract refers to disciplinary and grievance policies. It is important to have such policies, but these should not form part of the contract of employment (so that it is possible to change them from time to time, and so that an employee cannot complain about breach of contract if the policy is not followed to the letter). It is strongly advisable to have a health and safety policy (a requirement for an employer of five staff or more). Guidance about drawing up a health and safety policy is available from the Health & Safety Executive. It is also strongly advisable to have an equal opportunities policy. These policies should be brought to the employee’s attention upon joining employment and as part of their induction.
